Piper news?

I hope that the owners recover the dog and then they sue not only the rescue but also the person 'running' the rescue over all costs and damages that were incurred over this whole mess. I'm not a sue happy kinda person, but in this case ? Absolutely.
 
The latest is that the defendant filed a counter claim.

However, this is what showed up on the court docket today:

THE COURT WILL HOLD AN EVIDENTIARY HEARING ON PLAINTIFFS' REPLEVIN CLAIM AT THE JULY 23,2015 HEARING, ALSO NO OTHER CLAIMS CURRENTLY BEFORE THE COURT WILL BE HEARD PER JUDGE BRANDT

Replevin - the process to have property (Piper) returned.
 
Thanks for the update - hopefully this will be over in another month. Anxiously awaiting the outcome as the decision will have implications for anyone who has a dog with a microchip.

Fingers crossed Piper gets back to her rightful owner and has not been harmed in the interim!
 
I'll be surprised if this ever comes to a satisfactory conclusion. There is a reason this dog hasn't been returned and I would be surprised if it is her ability to breed. I will continue to hope for Piper to be okay and returned to her rightful home but as the clock ticks I have less faith that this will be the case.

New documents released. You have to hit the comments to see all 11 pages of the reply filed by Veronica's attorney if you want to read all the legalese. Cliff notes version is all the counterclaims filed by COSR are frivolous, statute of limitations is up or not under the jurisdiction of this court so throw them all out and fine their butts for trying to delay the trial yet again...

Today the Bring Piper Home FB page posted this. I think this is pretty clearly written and a good reminder of what has happened. Obviously, it is written by a pro-Piper supporter so if you are trying for something completely devoid of influence, well, I am not sure that exists anymore as by now the lines are pretty solidly drawn. I just thought it was an interesting read. I really like the analogy of the necklace.

Also, I have to point out to the many members and "guests" that read the SN pages, this battle affects us all. Precedents are getting set as to how ownership is proven, when it can be proven, what rights we have should our dogs land into someone else's possession for whatever reason. This is important territory for us all.

One simple thing, though, to protect your own little ones -- take this moment and check your microchips. Next time you are at the vet have them scanned to make sure they read. Go to the database and make sure everything is updated. Register with more than one database (you can do that). Put together a binder for your dog(s) with everything you have from papers to pictures to vet records to licenses to health screens, everything. Compile a photo file of the dog with you and your family over time from acquisition to current -- make sure those pix have the original date on the file or have them on a camera card with date stamps. Have at a moment's grab ways to show without a doubt your dog is your dog. It might help someday.

I still do NOT understand/can't process how an owner, who proves with proper paperwork that her property is HER property, can NOT get justice and have the PROPERTY returned in a timely manner. And what makes me LIVID, is this is a "rescue" why are they holding a dog CAPTIVE/PRISONER???? I just do NOT get that, it doesn't jive with the purpose or mission of a rescue. And if a "rescue" can overrule the validity of a microchipped animal, on a whim or NO grounds ...that really affects the whole microchipping procedure. WHY would they NOT wait for the Vet who had the records, did the microchipping, to get back and CHECK the records, holiday or not, that makes NO sense. Again, when is YOUR PROPERTY considered NOT your property-when did it become arbitrary or selective??? How is that even LEGAL considering there is proof??? If records prove it, and the breeder said go ahead with DNA testing, that should be the END of it. NO court needs to be involved...where is the "case"??? Custody is based on OWNERSHIP??? Especially since the dog wasn't at all abused or neglected, it just escaped.
