I actually completely agree with you. I think that the option should be there and that decision made by a judge who takes into account the entire situation...

Our incident had an unsupervised dog breaking a tie out, leaving it's property in an offensive and predatory attack on a leashed dog under control of its owner. I wouldn't lump that together, for instance with two dogs escalating somewhere like a dog park... totality of circumstances to me would dictate handling those two incidents differently. One size doesn't fit all.

Holy cow Margi-- $6,000?? We just broke $1,000 during our last visit. I imagine it will end up in the neighborhood of 2... she has some weird rental agreement, I wonder if the landlord knew about the dogs....

Exactly right Jess... she was fined $50 for both dogs being unlicensed... she was unable (or unwilling) to pay that that day. We already have an order for restitution once all of the bills are in... that's been set out until august to give us a chance to hopefully be done with everything related to this. My hope is that the judge gives a time period for her to pay it off in.
 
Sadly the vet convinced her he could save the cat by amputating the rear leg. This and the subsequent efforts to save her ran up quite a bill.
The situation was similar--the pit broke out of her yard and into my friends. Perhaps your insurance people can get you info re your situation, as it would seem you may have a "can't get blood from a turnip" situation.

I should have been more specific - every bite/dog attack case needs to be reviewed not only by a judge, but also by a recognized dog behaviorist or trainer. I am not for an auto euth for any bite incident. Depending on the circumstances, pretty stiff fines and/or seizure of the dogs should be in order.

Have you thought of contacting their landlord (the attacking dog's) and asking about insurance policies ? If nothing else, perhaps these people will get kicked out of their house because of this - then the dog is no longer a threat to the neighborhood.

I was thinking something very similar to this actually. Contact the landlord. The landlord probably has a mortgage and therefore, must be insured. The dogs probably aren't on it, but contacting the landlord will force the issue.
 
Rumor has it, the landlord is starting eviction proceedings... sad because she has a somewhere between 5-7 little kids. We'll see what the judge says come the August date. I'll request an end date that the money must be paid by. If that date is set, and comes and goes then we'll go through a civil suit. He is looking so good (the draining has almost stopped) I am confident we'll have all of our bills before the next court date.

Although, contacting the landlord might actually be a good idea in case she ups and disappears...
 
Glad Watson is getting better. Good idea about going after the landlord. I doubt he would want his insurance to be billed against because of a tenant's lack of action. It can happen.
 
And MOST importantly - glad to hear that Watson is improving and doing so well. Must be all that good TLC you are giving him !
 
Another thought - wonder if child protective services knows she has all these kids living in the house with a dog that is known to attack unprovoked ? I'd be sending court papers to them, too. You may be doing those kids a favor in the long run.
 
So glad to hear Watson is improving and doing better everyday! How is your boyfriend and you doing in your recovery from the bite wounds?
